Federal Judge Blocks FTC Non-Compete Ban

The wait is over. On August 20, 2024, the United States District Court for the Northern District of Texas blocked the Federal Trade Commission’s (FTC) proposed ban on non-compete agreements. The court determined that the FTC lacked the authority to enforce the ban because it was “unreasonably overbroad.” The FTC non-compete ban will not take effect on September 4, 2024. The FTC is expected to appeal the decision to the Fifth Circuit Court of Appeals.
